The terms and conditions of using www.carerspark.com and all associated services are outlined in this Agreement.

Accessing, browsing, or otherwise using the Site indicates that you agree to the terms and conditions. Please read this Agreement carefully before proceeding. carerspark.com reserves the right to change all terms and conditions of this website at any time.

1.Order Acceptance

Please note that there may be certain orders that we can not accept and must cancel.

We will bear the risks and responsibilities in the transportation of goods. In some cases, these responsibilities and risks are transferred to the express logistics service provider. After you sign the goods, the risk of loss of goods will transfer to you.

If you did not receive any products, please contact us and we will ship again the product you ordered after confirming some details.

2.Pricing in Different Currencies

Pricing of products sold by carerspark.com is based upon figures calculated in U.S. Dollars (US$). Prices displayed in other currencies are converted from U.S. Dollars according to the most up to date conversion rates. Denominations of currency on the Site, other than on the individual product page, may not be the most current. Areas of the Site where non-U.S. denominations of currency might be inaccurate include, but are not limited to, promotional banners, promotional pages, and information on product category pages. The price displayed on an individual product page, regardless of currency denomination, is the current price you are liable to pay to carespark.com, excluding shipping.

3.Use of Carespark:

3.1To be eligible to use the Services and accept the Terms, you must be at least 16 years old or higher based on the age of majority in your jurisdiction. You will be solely responsible for all access to and use of this site by anyone using the password and identification originally assigned to you, regardless of whether or not you authorized such access to and use of this site.

3.2 You acknowledge and agree that carerspark.com may amend any Terms at any time by posting the relevant amended and restated Terms on the Site. By continuing to use the Services or the Site, you agree that the amended Terms will apply to you.

3.3The Terms may not otherwise be modified except in writing by an authorized officer of carerspark.com.

3.4 Carespark.com can ship from different warehouses. For orders with more than item, we may split your order into several packages according to stock levels at our own discretion.

4.Intellectual Property Rights

Unless otherwise noted, all intellectual property rights in any content of the Site, (including text and other materials, graphics, photography, images, video, sound illustrations, Product layout and design, icons, software and trademarks) are owned by us or our licensors. Except as expressly set out here, nothing in these terms gives you any rights in respect of any intellectual property owned by us or our licensors, and you acknowledge that you do not acquire any ownership right by downloading content from the Site. In the event that you print off, copy or store pages from the Site (only as permitted by these terms), you must ensure that any copyright, trademark or other intellectual property right notices contained in the original content are reproduced.

5.Additional Fees – Taxes, Duties, Customs

The Fees are typically determined based on a combination of factors that may include:

  • The merchandise's country of origin or manufacture
  • The merchandise classification, using a system adopted by the countries that we ship to
  • VAT rates are set by the country to which the order is shipping
  • Select countries will be able to view the total amount of applicable fees, duties and tax/VAT for your order during the checkout process

Note: If you refuse delivery of the shipment, you are responsible for payment of all return shipping fees and any applicable fees, duties and taxes; in this case, all such return shipping fees and any applicable fees, duties and taxes will be billed to the method of payment you used. Shipping fees are not refundable for undeliverable shipments or refused shipments. If you have additional questions, please contact customer service.

6.Accepted Payment Methods

All payments for orders are processed by Stripe or PayPal. At no stage of the order or payment process do we hold any of your credit or debit card details. Any personal data you submit to Stripe will be processed by Stripe and any personal data you submit to PayPal will be in accordance with its privacy policy.

We accept the following payment methods:

  • Visa
  • Mastercard
  • PayPal

You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorize payment for any reason. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.

7.Delivery

Your order will be fulfilled by the delivery date set out in the Order Confirmation.

Your order will be delivered to the shipping address you specify when placing your order. Orders cannot be delivered to PO Box or similar addresses. We deliver to all addresses within the united states.

Products comprised within the same order cannot be delivered to different addresses.

Deliveries are made by standard shipping or USPS  and take place on Monday to Friday, excluding public holidays, usually within the hours of 9 AM and 5 PM PST. Most orders are delivered within 5 business days.

Please be aware that items are dispatched within 24 hours of receiving payment. Orders are shipped and delivered Monday to Friday. Orders placed over a holiday or during the weekend will be processed on the next business day. Packages will arrive within 2 business days.   

During peak times of the year, orders may have delayed dispatch times. We endure to get any orders dispatched at soon as possible. Please look out for your dispatch confirmation email.

8.Our Refunds Policy & Consumer Rights

Every purchase is risk free. If for any reason you are not satisfied with your Product and wish to return it, you have 30 days to return such item(s). Please note that we can only accept returns of:

  • any Product which has been sealed for health protection reasons and so cannot be re-sold provide that it is returned unopened, unused, in its original packaging and in its original condition, enclosing your proof of purchase;
  • any other Product if it is still in its original packaging and in a resaleable condition, enclosing your proof of purchase.

In every case, you will also need to return any free items that were delivered to you with the Product You will receive a full refund of the price paid for the Product(s). We will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your return.

Details of the consumer rights described above, and an explanation of how to exercise them, are provided below and in the Order Confirmation. Nothing in this section affects your legal rights.

If you are returning your Product to us you must contact our Customer Services department at support@carerspark.com who will provide you with a printable return slip with a confirmation number to include with your return shipment, along with the address for returning the Product to us. Please be sure to package the parcel securely (making sure you include a note of your name, address and returns number inside the parcel) and then return it to us. You must return the Products to us within 7 days of notifying us of the return. You will be responsible for the cost and risk of returning the items to us.

You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right to claim the cost of any deterioration from you.

If any Product you order is damaged or faulty when delivered to you, the price of the Product shall be refunded to you in full, including the cost of delivery. If you believe a Product was delivered damaged or faulty, you must inform us using the returns process set out under the paragraph above.

Product Information Whilst we have taken reasonable steps to depict Products as accurately as possible through the photographs and other images featured on the Site, the detailing (such as colour, pattern and texture, etc.) You see on-screen will depend on your monitor and, as such, may not exactly reflect the actual detailing of a Product when you receive it.

Any information on the Site regarding sizing and technical specification of Products is included as a guide only. If you are in any doubt as to the size or technical specification of any Product you require, we recommend that you contact us prior to placing an order at support@carerspark.com.

9.Customer Reviews

If you wish to include a Product review, we ask that these give genuine feedback, are respectful and non-threatening. We have a zero tolerance policy for any review designed to mislead or manipulate fellow customers. We do not accept reviews that are defamatory, invades the privacy of others, that contain obscene, unlawful or intolerant language.

We don't allow anyone to write reviews as a form of promotion and will remove at our discretion:

  • A negative review from a seller of a competitor's product.
  • Multiple negative reviews for the same product from one customer.
  • A review in exchange for monetary reward.

10.Our Liability

Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

Subject to the above, we will use reasonable endeavours to verify the accuracy of any information on the Site but make no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the Site or that it will be timely or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:

  • economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or
  • loss of goodwill or reputation; or
  • special or indirect losses

suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

Any liability we do have for losses you suffer is strictly limited to direct losses that were reasonably foreseeable in which case our liability shall be limited in each case to a sum equal to the price paid by you for the Products in respect of which any such damage or loss arises. This limitation of our liability does not affect any of your statutory rights.

11.Miscellaneous

If any provision of these Terms is held by any competent authority to be invalid, unlawful or unenforceable in whole or in part, the validity or enforceability of the remaining part of the relevant provision and any other provisions will remain unaffected nor will it affect the validity or lawfulness of that provision in any other jurisdiction.

These Terms and any Contract shall be governed by the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the English Courts.
